Death penalty threatens to once again embroil Brown

SACRAMENTO -- The death penalty, the polarizing issue that has shadowed Gov. Jerry Brown's political career, threatens to embroil the governor once more with a bill to abolish capital punishment making its way to his desk.

This go round, however, could turn out much differently for Brown, political analysts suggest.

For one, a legislator, Sen. Loni Hancock, D-Berkeley, is taking the lead on abolishing the death penalty, not Brown. Plus, her bill must be approved by voters, who appear to have shifted from their hard line, pro-capital punishment stance of previous years.

But first, the bill must go through Brown, whose tumultuous history with capital punishment includes a failed 1977 attempt to block the reinstatement of the death penalty. And he has been irrevocably linked with the voter-recalled Rose Bird, his pick for the state Supreme Court chief justice, who became a national poster child for problems with California's courts for regularly overturning death sentences.

"There are other things he wants to do in politics, like running for re-election," agreed Max Neiman, senior research fellow at the Institute of Governmental Studies at UC Berkeley. "He doesn't want to fire up a wedge issue that causes some loss in an election. But my gut tells me this is less of a political risk than it might have been years ago, particularly given all the other stuff people are worrying about."

Brown might view a fresh look at the issue as a chance for vindication, said Barbara O'Connor, former director of the Institute for the Study of Politics and the Media at Sacramento State.

"I think he will sign it happily," said O'Connor, who served under Brown in his second term. "It is consonant with his internal beliefs, with what he believed as a young man."

Hancock's legislation, SB490, if approved for the ballot, would ask voters to do away with the death penalty but require life imprisonment with no chance for parole. But rather than pursue the moral argument that Brown took in his attempts to block the death penalty, Hancock has provided compelling fiscal reasoning for eliminating capital punishment.

The death penalty has cost the state $4 billion since 1978, according to a recent 200-page study produced by U.S. 9th Circuit Judge Arthur Alarcon and Loyola Law School professor Paula Mitchell.
